I believe that Secretary Napolitano has an addiction to ammunition buying: Signs of shopping addiction include the inability to stop oneself from making purchases, conflicts with loved ones over expenditures and lying about shopping.

Secretary Napolitano really should read more Erma Bombeck, she may learn something about herself.

The Department of Homeland Security (DHS) put in the third solicitation of this year for more ammunition on March 18, for 360,000 rounds of 165 grain .40 caliber S&W jacket hollow point (JHP) rounds.

Today, the winner of the contract was announced, and Garcia Enterprises, a frequent awardee of ammunition contracts was the winner. They receive $105,490.80 for the ammunition, or at a steal of a deal at only 29.3 cents a round.

This contract award comes days after Immigration and Customs Enforcement (ICE), one of the largest buyer of ammunition, that they did not have sufficient ammunition for training – even though hundreds of millions of rounds have been contracted for purchase. From the National Border Patrol Council website:

Why is there an ammunition shortage? Why can’t Border Patrol agents get enough ammunition to maintain proficiency, especially at a time of increased cross-border smuggling and illegal activity? Where is all this ammunition going?

According to financial information provided by Senator Tom Coburn (R-OK), Customs and Border Protection (CBP) purchased 36,475,000 rounds of ammunition at a cost of $12,255,040 for FY 2012, with plans to purchase more for FY 2013 at a cost of $12,528,146. In total, Secretary Napolitano plans to spend $37,263,698 on a variety of ammunition for all agencies under her control this year. As of November 20, 2012, CBP had 94,404,329 rounds of ammunition in its inventory. DHS had 263,733,362 rounds available.

With all of the ammunition purchases, let’s learn something about this particular type of round.

The .40 caliber round is a 10 millimeter round, which is slightly larger than a 9 mm round and smaller than a .45 caliber (11.43 mm).

The internet is filled with comments as to the legal use of hollow point rounds, and they are legal to use in combat. Most people will wrongly state that their use is outlawed in the Geneva Convention, but it was the International Peace Conference at The Hague that the use of expanding bullets were discussed. The ammunition’s forerunner was banned in 1899, and a portion of that ban is shown here:

“Declaration on the Use of Bullets Which Expand or Flatten Easily in the Human Body” adopted at the First Hague Peace Conference of (29 July) 1899 which states:

The Undersigned, Plenipotentiaries of the Powers represented at the International Peace Conference at The Hague, duly authorized to that effect by their Governments,

Inspired by the sentiments which found expression in the Declaration of St. Petersburg of the 29th November (11th December), 1868,

Declare as follows:

“The Contracting Parties agree to abstain from the use of bullets which expand or flatten easily in the human body, such as bullets with a hard envelope which does not entirely cover the core, or is pierced with incisions.”

The present Declaration is only binding for the Contracting Powers in the case of a war between two or more of them.

It shall cease to be binding from the time when, in a war between the Contracting Parties, one of the belligerents is joined by a non-Contracting Power.

The United States only conceded to this, but did not sign.  Where the U.S. did commit to was the Hague Convention IV of 1907, Article 23(e) of which Annex states:

“…it is especially forbidden –

To employ arms, projectiles, or material{sic} calculated to cause unnecessary suffering;”

The US’s observation of the Convention meant that ammunition used by troops would be solid ball ammunition. However, in 1985 the rules of combat changed with an opinion written by Judge Advocate General, written by Col W. Hays Parks, Chief of the JAG’s International Law Branch, for the signature of Major General Hugh R. Overholt, which stated:

“…expanding point ammunition is legally permissible in counterterrorist operations not involving the engagement of the armed forces of another State.”

In October of 1990, Col. Parks, at the request of the Commander of the United States Special Operations Command (USSOCOM) and coordinated with the Department of State, Army General Counsel, as well as the Offices of the Judge Advocates General of the Navy and Air Force wrote a Memorandum that concluded:

“The purpose of the 7.62mm “open-tip” MatchKing bullet is to provide maximum accuracy at very long range. … Bullet fragmentation is not a design characteristic, however, nor a purpose for use of the MatchKing by United States Army snipers. Wounds caused by MatchKing ammunition are similar to those caused by a fully jacketed military ball bullet, which is legal under the law of war, when compared at the same ranges and under the same conditions. (The Sierra #2200 BTHP) not only meets, but exceeds, the law of war obligations of the United States for use in combat.”

And again in 1993, an opinion by Col Parks allowed the U.S. Special Operations Command to use a Winchester 230-grain JHP for issue with its H&K-manufactured Mk 23 Mod 0 pistol.

  • Velocity (VEL) measured in fps and was recorded 4 feet from the muzzle prior to gel-block entry. Gel blocks were placed at 3 feet and;
  • Penetration (PEN) was measured in inches to the nearest quarter inch.

After a bullet enters your body, the damage continues for 8 inches, more than enough to damage all the major organs, causing certain death without prompt medical care. Put your finger onto your abdomen and then ask yourself, “What lies behind here that could make me bleed to death?”

This is why we should worry about an out-of-control woman hell-bent on buying up ammunition for some unknown Quixotic mission to drive fear in the hearts of her fellow Americans. And like Quixote, Secretary Napolitano may suffer from, “various conditions from paranoia, persistent delusional disorder, and folie à deux to a ‘healthy reaction to a mad world.’ ” and therefore desperately needs an intervention before it’s too late.
