Father Loses Custody of Kids Due To Religious Beliefs

Craig Scarberry of Indiana had 50/50 custody rights with his wife for several years. Recently, however, a judge in Indiana reduced his visitation to just 4 hours per week and custody once every second weekend.

Scarberry, who was baffled by the judge’s decision, began pouring over court papers looking for the reason for the judge’s ruling. What he found may violate the very foundation of The U.S. Constitution’s protection of personal religious beliefs.

According to Scarberry and his attorney, the only viable explanation is that the judge ruled in favor of the childrens’ mother because of his religious beliefs. Within the ruling, the judge mentioned, on two occasions, Scarberry’s religious beliefs as being a problem between the two parents:

“The father did not participate in the same religious training as the mother…the father was agnostic.

…

“When the father considered himself a Christian, the parties were able to communicate relatively effectively.”
