How the FBI Had to Rewrite the Law for Hillary to Let Her Off the Hook

The criminal “just us” system continues to work superbly for untouchables at the top like Hillary Clinton.

The FBI has officially determined that no charges will be handed down in Hillary’s State Dept. email server scandal because… “she had no intent to harm”.

In point of fact, as it has been pointed out at length, the FBI essentially had to rewrite the law to let Hillary off:

There is no way of getting around this: According to Director James Comey (disclosure: a former colleague and longtime friend of mine), Hillary Clinton checked every box required for a felony violation of Section 793(f) of the federal penal code (Title 18): With lawful access to highly classified information she acted with gross negligence in removing and causing it to be removed it from its proper place of custody, and she transmitted it and caused it to be transmitted to others not authorized to have it, in patent violation of her trust. Director Comey even conceded that former Secretary Clinton was “extremely careless” and strongly suggested that her recklessness very likely led to communications (her own and those she corresponded with) being intercepted by foreign intelligence services…

In essence, in order to give Mrs. Clinton a pass, the FBI rewrote the statute, inserting an intent element that Congress did not require. The added intent element, moreover, makes no sense: The point of having a statute that criminalizes gross negligence is to underscore that government officials have a special obligation to safeguard national defense secrets; when they fail to carry out that obligation due to gross negligence, they are guilty of serious wrongdoing. The lack of intent to harm our country is irrelevant. People never intend the bad things that happen due to gross negligence. I would point out, moreover, that there are other statutes that criminalize unlawfully removing and transmitting highly classified information with intent to harm the United States. Being not guilty (and, indeed, not even accused) of Offense B does not absolve a person of guilt on Offense A, which she has committed.

And, as it has also has been pointed out, other people have been charged by the FBI for a similar offense specifically without malicious intent.

Not only has the system perfectly illustrated that the rule of law is dead, but the people have been clearly shown that the presidential candidate being shoved down America’s throats by the elite is, without a doubt, above the law entirely.

  • The FBI, being an executive agency, can’t do anything that the supreme commander of the branch, the president, can’t do. Only Congress has the authority to legislate.
    The best that other can do is pass rules and regulations, which have no jurisdiction outside of the their agencies and their employees, outside of which the Constitution is superior, regardless of how much they try to deny or ignore it.

      The FBI is an investigative agency (that’s what the “I” is for – Investigation) and its job is to gather evidence and transmit it to the AG for further action. It isn’t the FBI’s job to offer opinions like “no prosecutor in his right mind would pursue this,” especially publicly. That kind of determination is left to the AG. This bullshiite about “I’ll defer to the FBI’s recommendations” is cover for a decision Lynch does not want to make and by fobbing it off on the FBI Lynch assures her continued reign as AG under Clinton if she’s elected. Clinton said as much the other day. THE FIX IS IN – and We the People know it. But what will we do about it? Nothing.

    Essentially, the FBI said that carelessness is an absolute defense against breaking the law…but only if you’re one of the Chosen Few. For the rest of us, it’s called Criminal Negligence and we’re sent to jail for many years. Loretta Lynchmob, of course, knew that it was going to come down like this before she met with Slick Willy to give him the news and, not coincidentally, save her job under the next (ugh) Clinton presidency. Also…they’re not even trying to hide the obvious level of stinking corruption anymore, a sure sign that we have finally achieved Banana Republic status. When they stop tyring to hide it you know we’ve gone far past the point of no return.

    Is anyone really suprised by this. Just wait till the truth comes out that Trump ran for the nomination so when he got it. He could then sabatoge his own campaign so Hillary could get the presidency for sure. Without all the out rage and law suits from a real opponet.

    I find it interesting that this suddenly came about after the meeting between all Willie and Loretta Lynch in Arizona. I wonder what slick Willie offered Loretta Lynch? Grandkids and golf my hind tit. Since the head of the FBI answers to the attorney general, I wonder what Loretta Lynch threatened him with if he did not do what she told him to do and say. I don’t give a flying f*** what anybody says, Hillary is guilty as sin. People have had careers ruined and have gone to prison for less than what this skank has done.
