Report: New Gov Regulations Will Ban “Common AR-15” Ammunition

In a move clearly intended by the Obama Administration to suppress the acquisition, ownership and use of AR-15s and other .223 caliber general purpose rifles, the Bureau of Alcohol, Tobacco, Firearms and Explosives unexpectedly announced today that it intends to ban commonplace M855 ball ammunition as “armor piercing ammunition.” The decision continues Obama’s use of his executive authority to impose gun control restrictions and bypass Congress.

It isn’t even the third week of February, and the BATFE has already taken three major executive actions on gun control. First, it was a major change to what activities constitute regulated “manufacturing” of firearms. Next, BATFE reversed a less than year old position on firing a shouldered “pistol.” Now, BATFE has released a“Framework for Determining Whether Certain Projectiles are ‘Primarily Intended for Sporting Purposes’ Within the Meaning of 18 U.S.C. 921(a)(17)(c)”, which would eliminate M855’s exemption to the armor piercing ammunition prohibition and make future exemptions nearly impossible.

By way of background, federal law imposed in 1986 prohibits the manufacture, importation, and sale by licensed manufacturers or importers, but not possession, of “a projectile or projectile core which may be used in a handgun and which is constructed entirely . . . from one or a combination of tungsten alloys, steel, iron, brass, bronze, beryllium copper, or depleted uranium.” Because there are handguns capable of firing M855, it “may be used in a handgun.” It does not, however, have a core made of the metals listed in the law; rather, it has a traditional lead core with a steel tip, and therefore should never have been considered “armor piercing.” Nonetheless, BATFE previously declared M855 to be “armor piercing ammunition,” but granted it an exemption as a projectile “primarily intended to be used for sporting purposes.”

Now, however, BATFE says that it will henceforth grant the “sporting purposes” exception to only two categories of projectiles:

Category I: .22 Caliber Projectiles

A .22 caliber projectile that otherwise would be classified as armor piercing ammunition under 18 U.S.C. 921(a)(17)(B) will be considered to be “primarily intended to be used for sporting purposes” under section 921(a)(17)(C) if the projectile weighs 40 grains or less AND is loaded into a rimfire cartridge.

Category II: All Other Caliber Projectiles

Except as provided in Category I (.22 caliber rimfire), projectiles that otherwise would be classified as armor piercing ammunition will be presumed to be “primarily intended to be used for sporting purposes” under section 921(a)(17)(C) if the projectile is loaded into a cartridge for which the only handgun that is readily available in the ordinary channels of commercial trade is a single shot handgun. ATF nevertheless retains the discretion to deny any application for a “sporting purposes” exemption if substantial evidence exists that the ammunition is not primarily intended for such purposes.

BATFE is accepting comments until March 16, 2015 on this indefensible attempt to disrupt ammunition for the most popular rifle in America. Check back early next week for a more in-depth analysis of this “framework” and details on how you can submit comments.

  • From Team Obama’s point of view, this is probably the smartest way to enact gun control. Creating choke points on ammo and banning various types is likely to slip by the media and many common folks who support the Second Amendment, but do not follow gun news or are real knowledgeable on the subject. Guns are fun and shiny, whereas ammo sadly falls more into the details that many people are not interested in.

      Amazing how they see anything that can defeat even low level body armor as a threat. This twisted regime see’s threats everywhere. The paranoia of this government is frightening, and indicates a level of institutionalized psychosis. Even the US constitution that has stood for 200 years and has been a model of freedom to all the world, has become evil in their minds. A thing that must be overthrown.

      Governments become mentally ill when their leadership, is mentally ill. The Obama regime in lay men’s terms is “freaking nuts”, plain and simple! We are so screwed!

          States like NJ instituted gun laws that ban hollow point ammunition as …… “Cop Killer Bullets”. You might be surprised how many states have these stupid, counterproductive laws banning evil hollow point ammo!

          And here we are years later where virtually every cop wears body armor 24/7 on the job, but this useless nonsense law is still in place! Hollow point bullets that don’t richorche normally, because they deform, are still a threat by law, even though most criminal gun violence happens in inner cities where there is lots of concrete that makes bullets richorche, and most cops wear body armor where a bullet that deforms causes less injuries to officers than solid ridged jacketed bullets.

          New Jersey now by law puts police officers at greater risk, because of outdated, stupid, ignorant gun laws that the legislature won’t change because once passed, they don’t want to give up, for any reason. Even sanity!

        They are paranoid because they know that they are acting outside the constitution. Knowing this they fear an uprising of the American people, why do you think there is such a drive to diagnose as many Vets as possible with PTSD? Vets diagnosed with PTSD are not allowed to posses firearms.

      why do you think they closed the only lead mine in the US. That will drive up the cost of ammo since manufacturer’s will have to buy lead from foreign companies. Outlawing lead ammo is the next step since they “claim” that spent lead bullets are harming the environment

    Excuse me, but I don’t recall the ATF being a part of the legislative branch of government!! How can they legally and constitutionally create ANY law???

      ATF can’t can’t write law, but that’s not stopping them, now it’ll need to go to court for a long drawn out fight that will take years, perhaps decades.

      Personally I think Obama will make other vast societal changes while legal challenges are in the wind.

      Washington DC is notorious for these kinds of legal games, they knowingly author unconstitutional law, and it takes a decade or two to wind through the courts. The courts find these sicko laws unconstitutional, so they just pass another one, wash, rinse, dry, wear and repeat!

      All of Wahington DC’s gun prohibition laws are tossed as unconstitutional, but you still can’t buy a gun in Washington DC!

      There is no downside to progressives attacking the US constitution. They do it with impunity. Meanwhile citizens, human beings are encarcerated by these draconian laws intended to correct some imagined wrong that never actually happened.

          No one ever says “the 1A wasn’t about movies, magazines, porn, comic book, etc., but about criticising government” because most people seem to understand that freedom of speech and press means you can pretty say and print whatever you like regardless. Likewise if 2A is about owning weapons per se then it doesn’t if you have to intention of being part of some militia/military then it’s your right to do so anyway.

        The second amendment says nothing about sporting, or hunting, or target shooting, it does refer to militia. Militia responsible for defending the US from all threats foreign and domestic, it is the last line of defense for freedom, in your home and in our nation. This twisted sick government now sees the militia, the Pizza eating overweight American people, as it’s enemy.

        I’ll bet the farm you will see this president use drones against US citizens, on US soil, simply because he is afraid of them, before he leave office.

          Once this prince of fools is out of office he will be prey to court case after court case (even a an ex-president can be hit with a civil case for his time in office), not just in the USA, think about how pissed off the Mexicans are over F&F (this would be criminal, he’s NOT their ex-president) let alone how he ripped off EVERY wealthy person in the world (who all have lawyers) when he stole their GM stock. Like a thief covering his tracks, he has to throw a torch behind him as he leaves so we are too busy dealing with the fires he lights to come after him / them. I betting the NEXT set of laws / regulations / fires will be FAR worse then this and crazier as well.

          Drones are a distinct possibility and some folks say it has already happened in Indiana. Covered up as a “gas leak”. He looks to be starting WW III as well to cover his tracks.     For as small as the 7.62×39 cartridge is, it’s devastating…even compared to an SS109/M855 round. Any AK-47, AK-74, and Ruger Mini 30 will eat up this inexpensive piece of ammo!

    What I do not understand is that most of if not the majority of Terrorist acts and Robberies seem to overtly use Chinese made military style imported semi-auto AK47 types rifles and their derivatives.

    Which uses a completely different round a 7.62x54r ammunition that is not being ban by Obama!

    So, why band an America made weapons and American made ammuntion that is used in semi-auto form as the AR15, M16, M4, and it’s derivatives, largely used for target, police, security, and light hunting!

    Could it be that the US Government are afraid that members of the US Military or the police, might be able to acquire the stock 5.56×45 (.223) military rounds from sources other then their own military or police agencies or that the taxpayers might have too many rounds stockpiled and/or for sale?

  • Just another of the government’s relentless attacks that will only continue until Americans wake up to the fact that the Second Amendment is not the protection we have been led to believe it is.

    Think about it: The Amendment with the wording “shall not be infringed” is the MOST infringed, licensed, and limited Amendment of the entire twenty seven. Furthermore, a future generation are likely to see the Second Amendment whittled away entirely or repealed altogether. This is the inherent nature and of danger of optional Enlightenment rights as compared to God-expected, non-optional Biblical responsibilities, such as the following:

    “But if any provide not for his own, and specially for those of his own house [beginning with spiritual and physical protection], he hath denied the faith, and is worse than an infidel.” (1 Timothy 5:8)
